What Should I do if I think I might have an Automobile Products Liability Case?
If you believe that you have an automobile products liability case you should take the following steps to ensure that your case can be properly represented:
- If your automobile has been totaled by your insurance company, contact your insurance company, in writing, via certified mail, return receipt requested, and advise them that you believe you may have a products liability case and that your vehicle, its tires and all other parts should be preserved for use as evidence in any potential claim against the manufacturer. The vehicle, its tires and all other parts are the most vital pieces of evidence you have in an automobile products liability case and they should be stored indoors or completely covered so that they will not endure the elements, as the elements can change the condition of the vehicle, thereby altering your evidence.
- Take photographs of injuries sustained by you and/or any passengers.
- Take photographs of the crashed vehicle. Be sure to take photographs of the area(s) where you believe a particular product failed, such as a tire, seat belt, roof crush, etc.
- Take photographs of the scene of the crash.
- Obtain a copy of the traffic crash report prepared by the police at the time of the crash.
- Gather all documents relating to the purchase and service of the vehicle, regardless of the type of service that was done.
- If a family member was serious injured during an automobile crash, follow steps 1-6., above. You should be prepared to provide information about the injured party, including full name, address, date of birth, social security number, injuries sustained, doctors and hospitals visited, etc. This information is vital to the pursuit of a products liability claim.
- If the crash resulted in a fatal injury to a family member, you should follow steps 1-7, above. In addition, you will need to obtain a copy of the death certificate and provide information regarding any autopsy performed as well as funeral and/or burial information.
- Contact an attorney as quickly as possible. There is a statute of limitations on products liability cases and if that date passes, you will never be able to pursue the automaker for a claim related to that crash.
