Florida has one of the highest rates of pedestrian accidents in the Nation. Where you have high traffic density mixed with a large group of pedestrians, bad things are bound to happen. Many pedestrians are hit at night or in poor visibility conditions such as rain or fog. Some pedestrians are struck when they try to run across a darkened highway.

Every accident has issues regarding Comparative Negligence and pedestrian accidents are no exception. The court will balance the issues such as use of the crosswalk, visibility, speed, and other considerations when deciding a case. The jury will be instructed on comparative negligence but all other things being equal, most juries would place a large portion of blame on the vehicle rather than the injured pedestrian.

If you don’t want to be a statistic, wear white at night and follow the rules of the road. Try to walk as far off the pavement as possible and cross only at stop lights. Pedestrian safety is everyone’s job.

A young man was paralyzed in an auto accident in Ellenton.

On behalf of The Law Office of Omar Medina posted in Ellenton:

Austin Praught, 21, was paralyzed in an auto accident in Ellenton one year ago. His C-5 spinal vertebra was crushed and he is paralyzed from the shoulders down. He went through emergency surgery after the accident and then 4 weeks of Intensive Care at Tallahassee Memorial before being transported to Brooks Rehabilitation in Jacksonville.

One year later he is still on the road to recovery and is in need of intense physical therapy to keep improving. The Praught’s insurance does not cover the necessary therapy that he can get in Sarasota. But they would have to pay $10,000 plus 20 percent down to get him the necessary treatment in Sarasota.

His father, Joe, was in the construction business and has made every single piece of therapy equipment needed at home. While this equipment is working it is not enough to get the job done. Austin wants to get more movement in his hands to be able to take care of himself and he will need inpatient therapy to accomplish this.

Austin was attending college at Florida State University in Tallahassee at the time of the accident. He wants to go back and finish college and become a math teacher. He is able to move more than what he was told possible and is hopeful there will be further recovery down the road.

The family says the best time for recovery is 1 to 2 years after the accident. They are trying to raise the money themselves. They had a fundraiser on Saturday at the VFW Post No. 2488 in Palmetto. The event was open to the public and they were hoping to raise the money needed for the rehab in Sarasota at Healthsouth.

Donations can be made in the Praught name at any Bank of America location. Made out to “For the Benefit of Austin Praught” and specify that his location is in Florida to be deposited to Account # 229045503204 or send directly to Praught at the “For the Benefit of Austin Praught at 4701 8th Street Court East, Ellenton, Florida 34222.
